4REFUEL CANADA LP – DRAW TO WIN A TABLET
THIS CONTEST IS OPEN TO CANADIAN AND UNITED STATES RESIDENTS ONLY
AND IS GOVERNED BY CANADIAN AND US LAW.
ELIGIBILITY:
Contest is open only to residents of Canada and the United States who are of the age of majority or older in his/her province, territory or state of residence at the time of entry, except employees (and those with whom they are domiciled) of 4ReFuel Canada LP (the “Sponsor”), its parent and affiliated companies, representatives, dealers and agents, advertising and promotional agencies, Sponsor’s agent for administration of the Contest (hereinafter referred to as “Contest Administrator”) and any Contest suppliers or judges (collectively, the “Contest Parties”).
CONTEST PERIOD:
Contest begins on September 30th, 2015 at 12:00:00 p.m. Eastern Standard Time (EST) and ends on January 15th, 2016 at 11:59:59 a.m. EST (the “Contest Period”).
HOW TO ENTER:
No purchase necessary. You can enter the Contest through the 4Refuel.com contest application on the 4Refuel.com website during the Contest Period.
Grand Prize Draw:
To enter the Grand Prize draw go to the Website, click “Click to Enter” and fully complete the entry form by following the on-screen instructions. You will receive one (1) entry in the Grand Prize draw once you have fully completed and submitted the entry form in accordance with these Official Contest Rules (the “Rules”). There is a limit of one (1) entry in the Grand Prize draw per person/email address.
GRAND PRIZE winner selection process:
On January 15th, 2016 (the “Draw Date”) in Oakville, Ontario at approximately 12:00:01 p.m. EST, one (1) eligible entrant from the United States, and two (2) eligible entrants from Canada will be selected by random draw from among all eligible Grand Prize entries received during the Contest Period in accordance with these Rules. The odds of winning depend on the total number of eligible Grand Prize entries received for each of Canada and the United States. The Contest Administrator or its designated representative will contact each selected entrant by email. If: (i) the selected entrant cannot be contacted within three (3) attempts or five (5) business days of the Draw Date (whichever occurs first); or (ii) there is a return of any notification as undeliverable; then the selected entrant will be disqualified and the Sponsor reserves the right, in its sole discretion, to randomly select an alternate eligible entrant from among the remaining eligible Grand Prize entries.
BEFORE BEING DECLARED A GRAND PRIZE WINNER, each selected entrant must: (i) correctly answer a time limited mathematical skill-testing question without mechanical or other aid administered by the Contest Administrator during a pre-arranged, mutually convenient telephone call within five (5) business days of the Draw Date; and (ii) sign and return within ten (10) business days of notification a declaration and release form prepared by the Contest Administrator, which, among other things: (a) confirms compliance with these Rules and acceptance of the Grand Prize as awarded; (b) agrees to release the Contest Parties against any and all claims, damages, liabilities, costs, and expenses arising from any liability in connection with this Contest, the selected entrant’s participation therein and/or the awarding and use/misuse of the Grand Prize or any portion thereof; and (c) agrees to participate in video, sound recording or photographic presentations (“Recordings”) and providing oral or written statements relating to the Contest and permits the publication, reproduction and/or other use of his/her name, location, Recordings, statements about the Contest without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the Internet. If the selected entrant: (i) fails to correctly answer the skill testing question; or (ii) fails to return the properly executed Contest documents within the specified time; then he/she will be disqualified and will forfeit his/her opportunity to be a winner (and to receive the Grand Prize) and the Sponsor reserves the right, in its sole discretion, to randomly select an alternate eligible entrant from among the remaining eligible Grand Prize entries.
GRAND PRIZE:
There will be one (1) Grand Prize available to be won in the United States and two (2) Grand Prizes available to be won in Canada consisting of a 16GB Apple® iPad Air®, a retail value of CAN$439.00. The Grand Prize must be accepted as awarded and is not transferable, assignable or redeemable for cash. No substitutions except at Sponsor’s option. Without limiting the generality of the foregoing, Sponsor reserves the right, in its sole discretion, to substitute the Grand Prize with one of equal or greater value.
The Grand Prize will be delivered to each selected entrant by courier to the address provided by the selected entrant in the Contest documents. Risk of loss and damage to the Grand Prize will pass from the Sponsor to the selected entrant at the time of delivery.
GENERAL CONDITIONS:
No contact or correspondence will be entered into except with the selected entrants. If a potential or declared winner is not in compliance with these Rules, the Sponsor reserves the right to disqualify such entrant from the Contest. All entries are subject to verification and will be declared invalid if they are found to be illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with or unlawful in any way. Entries submitted by unauthorised means will automatically be disqualified. In the event that it has been determined that an entry has been made in any manner not sanctioned by these Rules, the entrant and all of his/her entries will be disqualified.
The Sponsor assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries or for any failure of the Website, for any problems or technical malfunction of any computer online systems, servers, access providers, computer equipment, software, failure of any entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from this Contest or the Grand Prize. The Sponsor reserves the right, subject to the approval of the Régie des alcools, des courses et des jeux (“Régie”), to withdraw or amend this Contest, or amend these Rules, in any way in the event of an error, technical problem, computer virus, bug, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of the Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.
This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries.
In the event of a dispute, entries will be deemed to have been submitted by the authorized account holder of the email address submitted on the entry form. “Authorized account holder” is defined as the person who is assigned an email address by an Internet provider, online service provider or other organization (business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry.
The Sponsor, with the consent of the Régie, reserves the right to cancel or suspend this Contest, or to amend these Rules, without prior notice or obligation in the event of any accident, printing, administrative or other error of any kind.
For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
By entering this Contest, each entrant (and his/her parent/legal guardian if he/she is under the age of majority in his/her province/territory of residence) expressly consents to the Sponsor, its agents and/or representatives, collecting, storing, sharing and using the personal information submitted with his/her entry only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at: http://www.4Refuel.com), unless the entrant (or his/her parent/legal guardian if he/she is under the age of majority in his/her province/territory of residence) otherwise agrees. INTELLECTUAL PROPERTY:
All intellectual property, including, without limitation, all trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned or licensed by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
DISCLAIMER:
Each entrant acknowledges that the contest is in no way sponsored, endorsed or administered by, or associated with, Apple®.
The Contest entry and related information submitted by entrants in connection with the Contest are provided to the Contest Parties, not to Apple®.
LANGUAGE DISCREPANCY:
In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and the French version of these Rules and/or disclosures or other statements contained in any Contest-related materials, including, but not limited to, the Contest registration form, or point of sale, television, print or online advertising, the terms and conditions of these Rules shall prevail, govern and control.
